2. Use of the Site
The Site is provided to share information about our organisational advisory and consulting services, publish content, allow visitors to subscribe to our newsletter, and enable prospective clients to book meetings via our Calendly integration.
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. Prohibited uses include, without limitation:
Attempting to gain unauthorized access to the Site or its systems
Using the Site to transmit harmful code, spam, or malicious content
Scraping, copying, or reproducing Site content for commercial purposes without permission
Impersonating any person or entity when booking meetings or subscribing to our newsletter
3. No Professional Advice
The content on this Site — including articles, insights, and any material shared via our newsletter — is provided for general informational purposes only. It does not constitute formal organisational, business, financial, legal, or professional advice, and should not be relied upon as such.
Any engagement for consulting or advisory services is subject to a separate, signed agreement between you (or your organisation) and Peak Strategies (Pty) Ltd, which will set out the specific scope, terms, and fees applicable to that engagement. Nothing on this Site creates a client relationship or contractual obligation on our part.
4. Booking Meetings
Meetings booked through the Site are scheduled via Calendly, a third-party service. By booking a meeting, you agree to Calendly's own terms of service and privacy policy. We are not responsible for the availability, functionality, or security of the Calendly platform.
Booking a meeting does not, on its own, constitute an engagement of our consulting services or create any contractual relationship. Any resulting work is subject to a separate agreement as described in Section 3.
5. Newsletter
If you subscribe to our newsletter, your sign-up is processed via Mailchimp and/or Squarespace Email Campaigns. You may unsubscribe at any time using the link provided in any newsletter email. See our Privacy Policy for details on how your information is used.
6. Intellectual Property
All content on the Site — including text, graphics, logos, the "David Haigh" name and brand mark, and any downloadable materials — is owned by or licensed to Peak Strategies (Pty) Ltd and is protected by applicable copyright and trademark laws.
You may view and share Site content for personal, non-commercial purposes, provided you do not modify it and you retain all copyright and proprietary notices. You may not reproduce, distribute, or create derivative works from Site content for commercial purposes without our prior written consent.
7. Third-Party Links and Services
The Site may contain links to, or integrations with, third-party services (including Calendly, Mailchimp, and Squarespace). We do not control and are not responsible for the content, privacy practices, or availability of these third-party services. Your use of any third-party service is subject to that service's own terms and policies.
8. Disclaimer of Warranties
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, and we make no warranties regarding the accuracy, completeness, or reliability of any content on the Site.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Peak Strategies (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of, or inability to use, the Site — even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including South African consumer protection law where applicable.
10. Indemnification
You agree to indemnify and hold harmless Peak Strategies (Pty) Ltd, its directors, and representatives from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Site or your violation of these Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa, without regard to conflict of law principles.
If you are accessing the Site from outside South Africa, you do so on your own initiative and are responsible for compliance with local laws, to the extent local laws apply.
